They just put the bullet there to show where it hit. If you look closer you can see that the bullet they fired went in one side and out the other.

@ LTCIt depends on where you are. In most parts of the US they are legal, but some of the more socialist states (California comes to mind...) might not like them very much. Really there's no reason to ban them just because of the bore size. Many of the Revolutionary war muskets were ~50 cal.
